OVERVIEW

This website is operated by SEAPACK HOMES LTD, trading as Ovalisse. Throughout the Site, the terms “we”, “us” and “our” refer to SEAPACK HOMES LTD, trading as Ovalisse.

Ovalisse offers this website, including all information, tools and services available through it, to you, the user, subject to your acceptance of the terms, conditions, policies and notices stated here.

By visiting our Site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms, conditions and policies referenced here or available by hyperlink.

These Terms apply to all users of the Site, including visitors, customers, account holders and individuals who submit content.

Please read these Terms carefully before accessing or using the Site. If you do not agree to these Terms, you must not access the Site or use our Services.

Any new features, products or tools added to the store will also be subject to these Terms. We may update these Terms by publishing a revised version on the Site. Changes will apply from the date they are published and will not affect orders already accepted by us unless required by law.

Nothing in these Terms limits or excludes your statutory rights under UK consumer law.

Our store is hosted by Shopify Inc. Shopify provides the e-commerce platform that enables us to offer and sell our products and Services.

SECTION 1 – ONLINE STORE TERMS

To place an order through our Site, you must be at least 18 years old and legally capable of entering into a binding contract.

You may not use our products or Services for any illegal or unauthorised purpose. You must comply with all laws applicable to your use of the Site and the products you purchase from us, including intellectual-property laws.

You must not transmit viruses, worms, malware or any other code of a destructive or harmful nature.

A material breach of these Terms may result in the suspension or termination of your access to the Services.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse or restrict access to the Service where we have a lawful and reasonable reason to do so, including suspected fraud, unlawful use, security concerns or a material breach of these Terms.

Information submitted through the Site may be transmitted across different networks and adapted to meet the technical requirements of connecting networks or devices.

Payment-card information is processed securely by our authorised payment providers and is encrypted during transmission in accordance with applicable security standards.

You must not reproduce, duplicate, copy, sell, resell or commercially exploit any part of the Service, Site content or access to the Service without our prior written permission.

The headings in these Terms are included for convenience only and do not affect their interpretation.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We take reasonable care to ensure that information published on the Site is accurate, complete and current. However, general content may occasionally contain errors or become outdated.

Information on the Site is provided for general information and should not be relied upon as professional, legal, financial, medical or other specialist advice.

Historical information is provided for reference only and may not be current. We may update Site content when reasonably necessary.

Nothing in this section affects our obligation to provide products that match their descriptions or your statutory consumer rights.

SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES

Product prices may change without notice. A price change will not affect an order that we have already accepted, except where required by law.

We may modify, suspend or discontinue all or part of the Site or Service for operational, security, legal or commercial reasons.

We will not make changes that materially affect an order already accepted by us without your agreement unless the change is required by law.

SECTION 5 – PRODUCTS OR SERVICES

Certain products may be available exclusively online and may have limited quantities. Returns, exchanges and refunds are governed by our Refund and Returns Policy and your statutory consumer rights.

Most UK consumers purchasing products online have the right to cancel their order within 14 days of receiving it without giving a reason, subject to applicable legal exceptions. Our voluntary Returns Policy may provide additional rights.

We make reasonable efforts to display product colours, materials, dimensions and images accurately. However, colours and appearance may vary slightly depending on lighting, photography and your device or screen settings.

Products must be assembled and used in accordance with any instructions, safety information and intended-use limitations supplied with them.

We may limit the sale of products to particular people, locations or jurisdictions where reasonably necessary. We may also limit product quantities to prevent fraud, unauthorised resale or misuse of promotional offers.

Product descriptions and prices may be changed before an order is accepted. We may discontinue a product at any time.

Products supplied by us must be of satisfactory quality, fit for their intended purpose and as described, as required by the Consumer Rights Act 2015.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

When you submit an order, you are making an offer to purchase the selected products. An order acknowledgement confirms that we have received your order but does not mean that it has been accepted.

A binding contract is formed when we send you a dispatch confirmation. We may decline or cancel an order before dispatch if:

  • The product is unavailable;
  • Payment cannot be authorised;
  • There is an obvious pricing or product-information error;
  • We cannot deliver to the address provided;
  • Purchase restrictions apply; or
  • We reasonably suspect fraud or unauthorised resale.

If we cancel an order after taking payment, we will refund the relevant amount to your original payment method.

We may limit quantities purchased per person, household, account, payment method or delivery address where reasonably necessary.

You agree to provide current, complete and accurate purchase, billing, delivery and account information. You must promptly update your information so that we can complete transactions and contact you where necessary.

For more information, please review our Refund and Returns Policy and Shipping Policy.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools or services supplied by third parties that we do not own or control.

Third-party tools may be subject to separate terms and privacy policies. You should review and accept those terms before using the relevant service.

To the extent permitted by law, we are not responsible for the availability, operation or content of independent third-party tools that are outside our control.

We may introduce new services, tools or features in the future. Such features will also be subject to these Terms and any additional conditions displayed when they are introduced.

SECTION 8 – THIRD-PARTY LINKS

The Site may contain links to websites or services operated by third parties. These third-party websites are independent from Ovalisse and are governed by their own terms and privacy policies.

We are not responsible for examining or verifying third-party content and are not liable for independent third-party websites, products or services that we do not control.

Please review a third party’s terms, policies and practices before providing personal information or completing a transaction with them.

Complaints concerning products or services purchased directly from a third party should be addressed to that third party.

SECTION 9 – USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If you submit reviews, comments, photographs, suggestions, ideas or other materials (“Content”), you confirm that you own the Content or have permission to submit it.

You retain ownership of your Content. You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, edit, translate, publish and display that Content for the purposes of operating, improving and promoting Ovalisse and our products.

Unless otherwise agreed, we are not required to treat voluntarily submitted Content as confidential, pay compensation for it or respond to it.

We may monitor, edit or remove Content that we reasonably believe is unlawful, abusive, defamatory, misleading, obscene, discriminatory or infringing of another person’s rights.

Your Content must not infringe intellectual-property, privacy, confidentiality or other legal rights. It must not contain false information, malware or harmful code, and you must not misrepresent your identity or the origin of the Content.

SECTION 10 – PERSONAL INFORMATION

Your submission of personal information through the Site is governed by our Privacy Policy.

Where legally required, non-essential analytics and advertising technologies will be used only after you provide consent through our cookie settings.

SECTION 11 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on the Site may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery costs, delivery times or availability.

We may correct errors and update information at any time. If we discover an obvious pricing or product error after you submit an order but before it is dispatched, we will contact you and offer you the choice of confirming the order using the correct information or cancelling it for a full refund.

We are not required to update historical or general information except where required by law. Nothing in this section limits your statutory rights.

SECTION 12 – PROHIBITED USES

You must not use the Site, Services or Site content:

  • For any unlawful, fraudulent or malicious purpose;
  • To encourage another person to commit an unlawful act;
  • To breach applicable laws or regulations;
  • To infringe our intellectual-property rights or those of another person;
  • To harass, abuse, threaten, defame or discriminate against another person;
  • To submit false, deceptive or misleading information;
  • To upload or transmit viruses, malware or harmful code;
  • To collect or track another person’s information unlawfully;
  • To spam, phish, scrape, crawl or use unauthorised automated systems;
  • For an obscene, abusive or immoral purpose; or
  • To interfere with or circumvent security features.

We may suspend or terminate your access for a material violation of these restrictions.

SECTION 13 – DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

We do not guarantee that access to the Site will always be uninterrupted, error-free or available. We may temporarily suspend access for maintenance, security, technical or operational reasons.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable when the contract was formed or for delays caused by events outside our reasonable control, provided that we comply with our legal obligations.

Our products are supplied for personal and domestic use. If you use them for commercial, business or resale purposes, we are not responsible for business losses such as loss of profit, revenue, opportunity or anticipated savings, except where liability cannot legally be excluded.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation;
  • Defective products where liability cannot legally be excluded;
  • Breach of your statutory consumer rights; or
  • Any other liability that cannot legally be excluded or limited.

SECTION 14 – RESPONSIBILITY FOR BREACHES

You are responsible for losses we reasonably incur as a direct result of your deliberate unlawful use of the Site or a serious breach of these Terms.

This section does not require you to compensate us for losses caused by us, losses that are not foreseeable or amounts that would be unfair or unlawful under applicable consumer law.

SECTION 15 – SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be treated as modified to the minimum extent necessary or removed.

The remaining provisions will continue to be valid and enforceable.

SECTION 16 – TERMINATION

These Terms remain effective while you use the Site or Services. You may stop using the Site at any time.

We may suspend or terminate your access where we reasonably believe that you have materially breached these Terms, used the Site unlawfully or created a security risk.

Termination does not affect rights and obligations that arose before termination, including payment obligations and rights relating to orders already accepted.

SECTION 17 – ENTIRE AGREEMENT

These Terms and the policies referenced in them constitute the agreement between you and us regarding your use of the Site and purchases made through it.

If we delay exercising or enforcing a right, that does not mean that we have waived it.

Nothing in this section limits any statement, product description or pre-contract information that forms part of your contract under applicable consumer law.

SECTION 18 – GOVERNING LAW

These Terms and any contract formed through the Site are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you retain the benefit of any mandatory consumer protections available under the laws of that part of the United Kingdom and may be entitled to bring proceedings in your local courts.

SECTION 19 – CHANGES TO THESE TERMS

You can review the current version of these Terms at any time on this page.

We may update these Terms by publishing a revised version on the Site. The updated Terms will apply from the date of publication.

The version applicable to a purchase will normally be the version in effect when you placed the order. We will not retrospectively change the terms of an accepted order unless required by law or agreed with you.
